[U/C to HM and Ms Sonia Gandhi]
Respected Prime Minister
The Press reports suggest that the IB is resisting CBI investigation into the conduct of Mr Rajendra Kumar, formerly Jt Director, Intelligence Bureau, Gujarat, and his possible prosecution.
Having been let down by the state police and the lower judiciary the Muslims of India in particular and the silent, vast conscientious, majority of Indians in general have pinned all hopes for justice in the matter of Gujarat mayhem on these on-going investigations by the CBI.
When the Prime Minister of India can be questioned by the Police under provisions of Chapter 12 of CrPC, surely the IB officer too can be examined. The Union Home Secretary’s attempts to moderate CBI investigations is tantamount to influencing CBI illegally, and is punishable u/s 186 IPC. The SC which frowned upon the CBI interim report being shared with the Law Minister will certainly not take this kindly.
At stake is more than the ego of some IB officers: the faith and patriotism of the minorities, and the credibility of India’s administration of justice as he issue reportedly involves blatant murder of 22 people in 17 fake encounter cases. The minorities generally feel that our intelligence apparatus has been infected with Muslim haters. And this complaint will take more than the appointment of a Muslim head of IB. The mere suspicion that the Gujarat government misused the central IB for its polarization agenda requires thorough probe.
The PM of India cannot remain a silent spectator to his officers – much less law enforcing officers – subverting justice. The entire world is watching the proceedings. The UPA govt owes it to all its voters and to the country to insulate CBI against all such interference and to pro-actively facilitate swift, firm, unhindered and thoroughly professional investigation into the misdeeds of all and sundry.
We entreat with you to immediately direct all concerned to ensure a free, fair and transparent inquiry. Please assure the nation accordingly so that the general air of demoralization and demotivation is cleared.
M Hasan Jowher
